DMCA Policy

My Realtor in New Zealand respects the intellectual property rights of others. We expect our users and visitors to do the same. This policy outlines our procedures for addressing alleged copyright infringement under the Digital Millennium Copyright Act (DMCA).

We are committed to protecting the original content featured on our site, including property descriptions, photographs of real estate, and articles related to the New Zealand property market. This commitment also extends to respecting the copyrights of others.

Reporting Copyright Infringement (DMCA Takedown Notice)

If you believe that any content on My Realtor in New Zealand infringes upon your copyright, you may send us a formal DMCA Takedown Notice. Please provide our Designated Copyright Agent with the following information:

  • A physical or electronic signature of the copyright owner, or a person authorised to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed. Include details such as the title of the work, and where possible, a URL or other identifying information.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity. You must provide information reasonably sufficient to allow us to locate the material on our website, such as a URL to the specific page or post.
  • Your contact information. This includes your name, address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the copyright owner.

Counter-Notification Process

If your content was removed from My Realtor in New Zealand due to a copyright infringement notice, you have the option to submit a counter-notification. This allows you to dispute the claim of infringement.

Your counter-notification must include the following:

  • Your physical or electronic signature.
  • Identification of the material that was removed or to which access was disabled. Also provide the location on our website where the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the U.S., for any judicial district in which My Realtor in New Zealand may be found). You must also accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receiving a valid counter-notification, we will forward a copy to the complaining party. We will then typically restore the removed material within 10 to 14 business days, unless the complaining party files a legal action seeking a court order to restrain the subscriber from engaging in infringing activity.

Repeat Infringer Policy

My Realtor in New Zealand reserves the right to terminate accounts of users who repeatedly infringe copyright. We will take appropriate action against users who are found to have uploaded or otherwise transmitted infringing material on multiple occasions.

Our policy is to maintain the integrity of intellectual property rights within the real estate content community. Continued infringement may result in permanent removal from the platform.
